Acceptance
By creating an account or using CapTap, you accept these terms and the CapTap privacy policy. If you do not accept them, do not use the service. If you use it on behalf of an organization, you confirm that you have the authority to bind it.
1. The service
CapTap lets you create a public professional page (profile, contact details, links, forms), share it through an NFC card, a QR code or a link, and, with Premium, enjoy extra features. The Android app shows cap-tap.com full screen, reads NFC cards and lets you buy Premium through Google Play. We may evolve the service's features; we will warn you of any change that significantly reduces what you paid for.
2. Your account
- You must be 18 or older and provide accurate information.
- You are responsible for keeping your password confidential and for what is done with your account. Tell us promptly about any unauthorized use.
- An account is personal. In an organization, its administrators can manage the team's accounts, as described in the privacy policy.
3. The content of your page
You keep ownership of what you publish on CapTap and you are responsible for it. You only grant us the right to host, display and transmit it to run the service. You agree not to publish:
- illegal, misleading, hateful, harassing, defamatory or sexual content;
- another person's personal information without their consent;
- content that infringes others' rights (copyright, trademarks, image);
- links to malware, phishing or scams;
- a page that impersonates another person or organization.
We may remove content or suspend a page that breaks these rules, and will inform you, except in an emergency or where the law requires otherwise.
5. Physical NFC cards
The CapTap card is ordered separately, on cap-tap.com. It only holds the address of your page; it keeps showing the current version of your page as long as your account exists. Some phones may not read a card (no NFC, NFC turned off, thick case): your page's QR code and link are always available.
6. The Android app
The app is free on Google Play. It needs the Internet and a compatible browser (usually Chrome) to show the service. It reads NFC cards only when you hold a card near the phone, and only opens web addresses: CapTap pages in the app, other sites in your browser.
7. Availability
We do our best to keep CapTap available at all times, but the service may be interrupted for maintenance, a provider outage or an event beyond our control. Keep a copy of the important information you put on your page.
8. Limitation of liability
The service is provided as is. To the extent permitted by law, Cap Commun is not liable for indirect damages (lost business opportunities, customers or data) related to the use or interruption of the service, nor for content published by users or the sites they link to. Nothing in these terms limits the rights granted to you by Québec's Consumer Protection Act or any other law that cannot be set aside.
9. Ending your use
You can delete your account at any time (see the privacy policy). We may suspend or close an account that seriously or repeatedly breaches these terms, after notifying you, except in an emergency. If we stopped offering CapTap, we would give you at least 60 days' notice.
10. Governing law
These terms are governed by the laws of Québec and the federal laws of Canada that apply there. Any dispute falls under the courts of the judicial district of Montréal, subject to the rights the law grants consumers.
11. Changes and contact
We may change these terms. The new version will be published on this page with its effective date; a significant change will be announced to you at least 30 days in advance by email or in the service. Questions: teo@cap-commun.com.
